Terms of Service

These Terms of Service ("Terms") govern your access to and use of Igitok (the "Service"), including our website, mobile applications, and any related features. By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Eligibility

  • 1.1 You must be at least 13 years old to create an account or use Igitok. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement and consent of a parent or legal guardian.
  • 1.2 By using the Service, you represent that you have the legal capacity to enter into these Terms and that all registration information you provide is accurate, current, and complete.
  • 1.3 We may refuse to provide the Service to anyone, at any time, at our discretion, including where we reasonably believe a user does not meet these eligibility requirements.

2. Your Account

  • 2.1 To use most features of Igitok, you must register an account using a valid email address or phone number, and complete any verification steps we require (including one-time passcode verification).
  • 2.2 You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at ericndungutse890@gmail.com if you suspect unauthorized access to your account.
  • 2.3 You may not create an account on behalf of another person without authorization, impersonate any person or entity, or misrepresent your identity, age, or affiliation with any person or organization.
  • 2.4 You may not sell, transfer, or license your account to any other party. One person may not maintain more than one account for abusive or deceptive purposes (for example, evading a suspension).
  • 2.5 You may delete your account at any time from within the app. Deleting your account will remove your public profile and permanently delete associated content in accordance with our Privacy Policy, subject to any legal retention obligations.

3. Acceptable Use

When using Igitok, you agree that you will not:

  • 3.1 Post, upload, or share content that is unlawful, defamatory, harassing, abusive, threatening, hateful, or that promotes violence, self-harm, or discrimination on the basis of race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristic;
  • 3.2 Post sexually explicit content involving minors, or any content that sexualizes, endangers, or exploits minors in any way — such content will be removed immediately, the responsible account permanently terminated, and reported to the relevant authorities and organizations, including the National Center for Missing & Exploited Children (NCMEC) where applicable;
  • 3.3 Upload content that infringes any copyright, trademark, trade secret, privacy right, publicity right, or other intellectual property or proprietary right of any third party;
  • 3.4 Engage in spamming, phishing, or the distribution of malware, or use automated means (bots, scrapers, crawlers) to access or collect data from the Service without our written permission;
  • 3.5 Advertise, sell, or facilitate the sale of illegal goods or services, including illegal drugs, weapons, or counterfeit items;
  • 3.6 Harass, bully, stalk, or intimidate any other user, or encourage others to do so;
  • 3.7 Attempt to gain unauthorized access to other users' accounts, our systems, or networks connected to the Service, or interfere with the proper functioning of the Service (including through denial-of-service attacks);
  • 3.8 Circumvent, disable, or otherwise interfere with security-related features of the Service, including age-verification or content-moderation systems;
  • 3.9 Use the Service for any purpose that is fraudulent or deceptive.

4. User-Generated Content

  • 4.1 You retain all ownership rights in the videos, photos, comments, and other content you submit to Igitok ("User Content").
  • 4.2 By submitting User Content, you grant Igitok a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, use, display, reproduce, modify (for formatting purposes, such as resizing or compressing media), distribute, and publish that content solely in connection with operating, promoting, and improving the Service. This license ends when you delete the content or your account, except to the extent your content has been shared with others and they have not deleted it, or where retention is required by law.
  • 4.3 You represent and warrant that you own or have obtained all necessary rights, licenses, consents, and releases to post your User Content and to grant the license above, and that your content does not violate the rights of any third party.
  • 4.4 We do not pre-screen User Content, but we reserve the right (without obligation) to review, moderate, refuse, remove, or restrict access to any User Content at our sole discretion, including through automated moderation tools (for example, automated detection of adult, violent, or otherwise policy-violating imagery), without prior notice.
  • 4.5 If you believe content on Igitok infringes your copyright, please send a notice to ericndungutse890@gmail.com including: (a) identification of the copyrighted work; (b) identification of the material you claim is infringing and its location on the Service; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized; and (e) a statement, under penalty of perjury, that the notice is accurate and that you are the copyright owner or authorized to act on their behalf. We will respond to valid notices and may remove or disable access to the reported content and, in appropriate cases, terminate the accounts of repeat infringers.

5. Virtual Items, Credits & Payments

  • 5.1 Igitok may offer virtual currency ("Credits") and virtual items (such as gifts, badges, or feature upgrades) that can be purchased with real money through the payment processors we integrate with (including, where enabled, Stripe and Paystack).
  • 5.2 Credits and virtual items have no monetary value, cannot be redeemed or exchanged for cash, cannot be transferred between accounts outside of features we explicitly provide for that purpose, and remain our property at all times. You are purchasing a limited, personal, non-transferable, revocable license to use Credits and virtual items within the Service.
  • 5.3 All purchases are final. Except where required by applicable law or expressly stated otherwise, purchases of Credits or virtual items are non-refundable, including where an account is subsequently suspended or terminated for violating these Terms.
  • 5.4 Prices for Credits and virtual items are subject to change at any time. We may also modify, suspend, or discontinue any virtual item, feature, or Credit package at any time.
  • 5.5 Payment processing is handled entirely by our third-party payment providers. We do not store your full payment card details on our servers. Your use of a payment provider is also subject to that provider's own terms and privacy policy.
  • 5.6 Any bonus Credits awarded through referrals, promotions, or sign-up bonuses are provided at our discretion and may be revoked in cases of abuse or fraud.

6. Third-Party Services

Igitok integrates with third-party services to operate certain features, which may include sign-in providers (such as Google or Apple), payment processors (such as Stripe and Paystack), cloud storage and content-delivery providers, push-notification providers, and analytics or content-moderation providers. Your use of features backed by these providers is also subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.

7. Reporting, Moderation & Enforcement

  • 7.1 You can report content or accounts that you believe violate these Terms using the in-app reporting tools. We aim to review reports promptly and take appropriate action, which may include removing content, issuing a warning, temporarily restricting an account, or permanently terminating an account.
  • 7.2 We may suspend or terminate your account, with or without notice, if we determine, in our sole discretion, that you have violated these Terms, created risk or legal exposure for us, or engaged in conduct that is harmful to other users, us, or third parties.
  • 7.3 You may appeal a moderation decision by contacting ericndungutse890@gmail.com. We will review appeals in good faith but are not obligated to reverse any enforcement decision.

8. Intellectual Property

The Service, including its software, design, graphics, logos, and the "Igitok" name and branding (excluding User Content), is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the rights explicitly granted to you to use the Service, no rights are granted to you in our intellectual property.

9. Disclaimers

  • 9.1 THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
  • 9.2 WE ARE NOT RESPONSIBLE FOR THE CONDUCT OR CONTENT OF ANY USER, ON OR OFF THE SERVICE. YOU USE THE SERVICE, AND INTERACT WITH OTHER USERS, AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE, OUR OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY U.S. DOLLARS (USD $50). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify and hold harmless Igitok, its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination (including Sections 4.2, 5, 8, 9, 10, and 11) will survive.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which the operator of Igitok is established, without regard to its conflict-of-law principles, except where mandatory consumer-protection laws of your country of residence provide otherwise. This section will be updated to name a specific jurisdiction once the operating entity is finalized.
